Terms and Policies

1. GUEST PROFILE

Oarsman Bay Lodge Ltd (OBL) welcomes budget travellers and families from all over the world. All guests will be required to complete a Guest Registration Form which includes Terms and Conditions identical to those set out herein.

2. LENGTH OF STAY

OBL has no minimum stay but three nights is recommended as the minimum. Average stay is 4.5 nights.

3. PAYMENT POLICY

Reservations will only be guaranteed and written confirmation will only be given once full payment for accommodation, meals and Government taxes is received. Payment is accepted by Visa or Mastercard. The Resort only accepts credit card payments at the Resort. Cash is only accepted in case of failure in the payment by card.

4. NOT INCLUDED IN PRICE

The stated prices do not include any services or activities not specifically mentioned as being included (either in these terms and conditions, OBL rate sheet or brochure), such as scuba dives, boating, fishing trips, other chargeable activities, international airfare, airport taxes, excess luggage charges, massages, personal incidentals, purchases from OBL Shop and communication charges.

5. CANCELLATIONS/UNUSED DAYS OR SERVICES

There is a cancellation fee applicable for any bookings cancelled. Booking cancelled within 7 (Seven)days time will apply 100% fee of the total cost, 25% fee for 30 days time and no cancellation fees for more than 30 days prior to the arrival. This includes but is not limited to flight delays, late arrivals, premature departures, or for non-use of transfers, meals or activities.

6. MEAL PLANS NOT COMMISSIONABLE

No commission is payable in respect of meal plans. All guests are required to purchase a meal plan even if meals are unused.

7. TRAVEL REQUIREMENTS

At the time of printing, guests travelling on United States, Canadian, Mexican, Australian or New Zealand passports do not require a visa for Fiji for visits of up to four months.  However, passports must be valid for at least three months. Visitors from other countries should make their own enquiries.

8. TRANSFER – NADI TO OARSMAN’S BAY LODGE

(a). Boat or plane:
Transportation to OBL is by Awesome Adventures “Yasawa Flyer Ferry” or Turtle Airways seaplane. Guests can choose to charter their own flight or travel by boat transfers. Bookings for boat and seaplane transfers may be made at the OBL Booking Offices or direct with provider.

(b). No Responsibility:
OBL does not accept any responsibility for any failure on the part of the guest to meet any scheduled departure times. Transfer times are restricted and publicised. Due to these restricted transfer times, same day connections between Nadi and OBL may not always be possible. Overnight or dayroom use before or after a stay at OBL is at guest’s own costs.

9. CHECK IN/ CHECK OUT TIME

OBL check in time is after 2.00pm and check out time is 11am.  In the event that a guest would like to spend extra time at the Resort, the office must be notified one day prior and provision of a day room is subject to availability. An additional charge may apply.
On the day of arrival, where appropriate, lunch is provided to the guest is not subject to their meal plan. (Additional $20.00 is charged exclusive of 5% =STT)

10. LUGGAGE LIMIT / LAUNDRY

Luggage limit for a seaplane transfer to OBL is 33 lbs. per person. A small fee applies for laundry service at OBL Monday through Sunday, and guests are encouraged to pack lightly.

11. AGE, DISABILITY AND HEALTH REQUIREMENTS

OBL will make every effort to accommodate the needs of aged or disabled persons.  At the time of booking, the guest must provide full details of any disabilities, allergies, special needs, infirmities or any health condition which may require special attention. No warranties are given in relation to the provision of these needs.

12. RESPONSIBILITY AND RELEASE

As a guest on OBL, the guest acknowledges and agrees as follows:

 (A) No Liability
OBL will use all due care and skill in the provision of its services and activities provided to guests.  Guests participate in activities and use services at OBL at their own risk.  No liability or responsibility is accepted by OBL for any injury, illness, damage, loss, accident, expense or any other claim arising from involvement in any activities or provision of any services howsoever suffered, even in circumstances where servants or agents of OBL may have negligently breached any duty of care that it or they may owe or have owed in connection with such activities, conduct, supervision, or the provision of services.  OBL will in no case be liable for either direct or indirect losses, arising from any such injury, illness, damage, loss, accident or expense including consequential loss or economic loss howsoever caused.

(B) Acknowledgment of Risk
Some sports and activities provided by OBL intrinsically involve the possibility of physical risk, which is greater than those encountered in daily life.  By taking part in such sports and activities the guests acknowledge that they:
(a) agree to comply with any rules, regulations and instructions provided by OBL in relation to the sports or activities;
(b) are physically and mentally fit and able to take part in the sports or activities;
(c) have not been provided with a representation or warranty concerning the suitability or qualification of persons supervising the sports or activities or in relation to any product used in association with the sports and activities;

  1. and the guest assumes the extra risks inherent in undertaking those sports and activities and the guest releases and indemnifies OBL from any liability for any injury, illness, damage, loss, accident, expense or any other claim arising.

(C) Release by Guest
The guest agrees to release OBL from any liability for any injury, illness, damage, loss,       accident, or expense whatsoever and howsoever arising from participation in any sport or activities or the provision of any services by OBL or any employees of OBL, or for the use of any product in association with any such activities and the guest further agrees to indemnify OBL against any liability, action or claim howsoever incurred, brought by or in favour of any person or individual, whether an employee of OBL or not in conjunction with any activity or service.

(D) Confirmation
The guest confirms and acknowledges that each of the representations that have been accepted in these Terms and Conditions are made on behalf of the guest and on behalf of all persons and individuals under the charge, care or custody of the guest and on whose behalf the guest has executed the Terms and Conditions.

(E) Travel Delay
OBL will not accept responsibility for any delay, additional expense or inconvenience that may be caused directly or indirectly by events outside its control.  Such events include the late arrival of international flights, civil disturbance, fire, floods, unusually severe weather, acts of God or of governments, failure of equipment or industrial action.

(F) Reservation Contract
The operator of the business is Oarsman Bay Lodge Limited.  When OBL accepts a confirmed guest booking, a contract is created between the guest, the agent or tour operator and OBL and all parties are deemed to have accepted all terms and conditions specified herein.

13. GOVERNING LAW

These terms and conditions are governed by the laws of the Republic of Fiji, and any legal action arising as a result of any booking with or any stay at OBL shall be governed by the laws of Fiji and shall be litigated in the Courts of Fiji.

14. BOOKING SERVICE

Turtle Travel Service as the booking agent in Fiji is not itself a carrier or hotelier and does not own aircraft, boats or resorts. The flights, boat transfers, resort stays and other arrangements are provided by carriers and hoteliers on their own conditions. Therefore, all bookings relating to guest stays at OBL are subject to terms and conditions and limitations imposed by airlines, operators, hoteliers and other service providers. Further, the responsibilities of air carriers are limited in accordance with international agreements and tariffs. Turtle Travel Service acts as an agent for services provided by operators and cannot be held liable for any of those providing services.

15. TERMINATION

OBL can terminate this agreement on 30 days written notice. This agreement may be terminated at any time upon the failure of the Wholesale Company to comply with the terms and conditions of the agreement. Notwithstanding any termination of this agreement, the Wholesale Company shall be entitled to have reservations honoured if made prior to date of termination which are confirmed and utilised thereafter.
